                                I can't belive I almost got arrested today..MAR. 23th

                                   when I was walking the dog.. around my block..

                                      the HAMMOND POLICE came down on me LIKE

                                         FLYS on COW-PIES......for my open carry of my

                                            .38 stub nose.. GUN ...... NOT DOG!! HA!  HA!....

                                            ANYWAY I told them the LAW.. THEY DID NOT SEE

                                            IT THAT-WAY!!!. They told me to get a BIGGER SHIRT

                                              to cover that gun or they would take it AWAY FROM

                                                ME!!!!!! ANY REPLYS GUYS.......????

Were you detained?  As in was it an involuntary encounter from which you were not free to walk away?

Did you refuse consent to the encounter?

Wow, never had a problem OC'ing in Hammond.  The one Hammond officer I had a conversation with knew OC was legal, but warned some other officers might take extreme precautions.  Guess you had a run in with some of those.  Sometimes it does have to do with the area you are in as far as how much trouble happens there, just makes the cops more on edge.  Hopefully you got the names of the officers involved, then you can try contacting the chief, Brian Miller, and see if he would care to educate his officers in Indiana law.

Keep OCing.  Maybe carry something MORE conspicuous.  Carry a pocket audio recorder.  When they say they will take it, ask, "By what authority will you take it?"

You could call the chief anyway.  There should be a report of the incident that you can get via the Freedom of Information Act.

I'm in Slacker, so if you would be so kind to mention whereabouts in south Hammond you were, I'd be more than happy to walk my great dane while OC'ing around the same area.  The south side of Hammond is very friendly, so it shouldn't have been a cop on edge about dangers.

I've OC'ed all around Hammond, even the walmart.  Never had an issue.

I can say that the only Hammond PD cops I've seen that have realized I was OC'ing was in Cabelas... which is of course south hammond.

I live in South Hammond and OC in the yard/street all the time as well.

Always ask for a supervisor so they can clear it up.  The hierarchy at HPD knows OC is legal.

The school shouldn't be an issue since you weren't on it's property, proximity doesn't matter.  There was a Hammond ordinance about parks & the sidewalks around the parks.  Just trying to get all the facts correct, were you possibly walking on the sidewalk right next to the park?  There's also a question of if the state law overrules the local ordinance, that depends on when the local ordinance was passed, something about 1994.  Not sure when I'll get over there since I'm leaving for Pittsburgh for a week soon and have a lot of things to take care of.

Also, almost forgot about this part.  They shouldn't have even bothered you without cause.  Open carrying isn't an excuse to harass the public.  Cops aren't allowed to pull over someone without cause.

Also, you have to be around Mike for a little while.

He's not rude or impolite or short with people in person.  Its just that his textings seem that way sometimes because he leaves out the diplomatic verbiage others use.  He's just quick and to the point.
