| Around 8:30 today, I was checking out in sporting goods at the Wal-Mart on Vets in Kenner. I bought some bullets, eggs, apples, and oatmeal. I was standing in line and I saw a Kenner cop (I thought he was a security guard). He swung over to my right side and I could see him looking to see if I had a gun. He asked me for my credentials. I explained I do not have to have a permit to carry the gun this way. He asked me who I was with and I said noone. He asked for my license. He called someone and told them my name, address (I told him my address changed), white male, etc. He asked me why I was carrying the gun this way. I told him since I do not have a CCW liscense this is the only legal way for me to carry. After I checked out he and someone who claimed to be a Wal-Mart security guard escorted me outside. Well, he said let's step outside, I guess to not cause a scene. The guard was plain clothed and did not have a gun or anything. He finished talking on the phone and started asking me erroneous questions that I could not answer. He said, "Common sense would tell you that carrying like that will alarm people", "If you saw someone carrying like that would you get alarmed", etc. He asked why I carry again and I said it is not illegal for me to carry like this. We then started talking about people that come to a place to shoot it up they have the gun concealed or already in hand. I informed them that Wal-Mart's policy was to abide by the laws of the state. The security guard said something like "Yeah that's right but... (something stupid). The cop told me that loads of people complained about the gun. (Interesting that they would send one cop to stop a terrorist.) They told me not come to the store like that anymore and I said "I will never come to this store again." We talked about some other things and the LEO asked me something else but I can not remember right now. It was important and when I remember I will post it. I am going to send a letter (e-mail) to Wal-Mart to explain the situation and inform them that they have lost a customer. I did not get any names because I was afraid they would get pissy(I xxxxxxxxxxxx. Not that it matters but I was carrying a Glock 22 in a Serpa Blackhawk. The first time I went in there there was not problem. I have been to that one, the one on Jeff Hwy, Winn-dixie on Airline, Subway, and a few other places. I never had a glitch before. This is unfortunate.

So some cop said something to you with some security guard, though what they said, while important, was forgotten. Great story.

Excuse me for forgetting one or two sentences in a twenty minute conversation between three people. Clearly the point of the story zipped right over your head. My description captures the jist of the experience.Last edited on Fri Jan 22nd, 2010 04:02 am by jensen_lover

Facts i.e names etc - specifics are lacking completely.
Suggest that you buy a good digital recorder for future use.

Wal-Mart's unofficial, official policy is a two edged sword. Saying that they follow state law is still not a mandate allowing guns. They are within state law if and when they ask you to change your conduct and/or leave - it is private property; therefore, carrying there is a privilege.
You got your "bullets and eggs", were not arrested - not a bad evening.

| I told the cop that if an agent of the company had asked me to leave I would have gladly left. Noone in the store seemed to care. What will happen if I go back to the store open carrying?

This may have something to do with "...and the LEO asked me something else but I can not remember right now."
Did the Security Guard inform you not to come back carrying or to come back at all?
Did the Security Guard request the LEO to inform you not to return carrying or come back at all?
If so, do not return to that store under the conditions you were told--you could be arrested for trespass. It's really as simple as that. It's a private property rights issue that most here at OCDO happen agree with--as it should be.

THIS is the PERFECT opportunity for real OC'ers to show up at the very same WalMart within 48 hours, as many as possible.

Exactly what did the Wal-Mart SG say that was stupid?

| Gotta love Kenner.... I get stopped all the time between 10 and New Orleans Power Sports because "you don't belong here and need to go back where you came from".... but i get this in St. Tammany and Plaquemines too.... guess it's my fault for living in New Orleans... they don't want "our type"

For the same reason Rosa Parks didn't ride a blacks-only bus.

Why not just go eat at shoneys instead?

Nice execution. Subtle, with only a hint of asshatery.

Call Walmart HQ and tell them the story and see what they say.

I will have to do that. My phone has been down for a few days so no Internet.

He started talking about kids and families. He made it sound like I was scaring the kids on purpose. I probably passed five kids and not a single one looked twice.

Bottom line - you've gotta man up in these situations. You are lawfully carrying.
If a peon employee or rent-a-cop confronts you, ask to speak to the manager. If the manager insists that he doesn't want you carrying, then leave and tell him you're taking your business elsewhere. Take it over the manager's head to corporate. And don't forget to tell corporate that there are thousands of your fellow law-abiding citizens that will hear about (insert company name here) mistreatment on opencarry.org.
And don't feel at any time that you're obliged to show ID, wait around, etc. Ask the magic question - Am I being detained? If not, tell them to have a nice day and go on your way. If yes, time to call your lawyer.
Questions?

One of the best answers I've seen on the forum.

One question. Who is your lawyer? Many of us are searching for Pro-2A lawers willing to take on open carry cases such as this. Since you advise calling your lawyer I assume you have one on retainer.

Why on retainer? There is not that much routine need.
There are several in my home state with whom I am on a first name basis. Does that count. Would you like a referral?
