They tried to charge him for carrying a concealed knife, because he had a box cutter in his pocket. The DA threw the case out when it got to court.

I got arrested a while back for excessively speeding in Portland (yeah I have a lead foot) and had to make a quick run to the cumberland county jail to give them $40 and leave. But I got a nice escort in a cruiser, and when they patted me down, they didn't even noticed the 3" Gerber folding knife clipped to my pocket. I forgot it was there because I carry it everyday, and didn't remember until I was in the secure area where they ask you for all your info.

I told the cop about it and he got all pissed off and gave me the same "trafficking in dangerous weapons" bullsh*t line until I politely reminded him that I was patted down by 2 of Portland's "finest" and they didn't see the shiny belt clip. I suggested to him that they get better training. I also told him that I knew the laws and my rights and that the trafficking was b.s. and he shut up in a hurry. I also got it back when i left an hour later :)

exactly, so any knife that you can open with the flick of your thumb, wrist , or the use of gravity is illegal in teh state of maine..........wich is BS cause i can grab the blade of a buck knife and flip it open, same with box cutter, even a straight razor to shave my face with.............i can see why switchblades, ballisongs *butterfly* and paratrooper knives may be illegal..........but heck a $1 bucket special talon 1.5" blade can be opened with one hand lol

If it were illegal, none of the stores would be able to sell knives under this law.

i really believe this law is up to the disgresion of the officer making the stop, i've been stoped with a spring assisted gerber..........no problems at all, but i've also been stopped with a frost cuttlery Ranger..............and had it confiscated lol

Jay - the law says "device in the handle," nothing about a thumbstud on the blade.  Also, that buck knife of yours doesn't open by gravity or an "outward or downward movement."  Seriously, let's not get ridiculous here.

The cops in Portland were laying on every charge they could find, like cops do in situations where they want to make sure the guy gets nailed down, and in this case, they got their d*cks slammed in the door.  As they should have.
