Just the other day I was at a gas station in Western ABQ, past the Rio Grande. My wife ran in to grab something to drink, so I decided to go in with my other daughter. We got a couple slurpees and we started to get back into the car when I noticed this guy standing about ten feet in front of my car looking pretty suspicious and watching us. My wife got into the drivers seat and I started to put my one year old in when I saw the guy wave another guy over and both started to walk behind me. (They were both wearing the exact same plaid sweater, just different colors). Note: I was bent over with my top half in the car buckeling my kid. I went on alert and quickly turned around before he got right up behind me. They first guy was hispanic and the second guy caucasian, both were pretty big. The hispanic guy kind of looked at me for a second (I was thinking that things were about to go down and I would have to try to defend myself against two guys that would have whooped me). He then asked me if I had a penny. A Penny!! What the heck? I told him no and stood there as they walked away. My concealed carry permit is no good in this state, so I don't carry as often as I should. I would open carry here but because of my job, if I were to have any run in whatsoever with police I would lose my job. I wish NM would take my CPL though... I just got it with the last year and I dread paying out alot more money for the same exact thing I already have.......

Nitrox314,

Well, you need to do SOMETHING for sure because you certainly DID have a close call! Had those guys wanted to do you a number, you'd have been done and just another statistic...and on the local news at 6. You had no way to defend yourself, let alone your family -- just like most liberals out there -- but YOU (we) know better.

You need to figure out SOME way to be armed...at ALL times.

At least have a shorty shotgun in the car you can grab...

New Mexico is an open carry state. Just open carry with a good retention holster. Just do not walk into any business that sells alcohol period.

Thanks guys. I will look into the UT Non-Resident license. I didn't know about that one before. I think after the close call, I will be OCing here regardless of what consequences there might be for my job. I'd rather lose a job and than my or my families lives.

Does anyone know any UT Non-resident CCW Trainers that do classes in NM?

Try Omega  Defense.  Reid Haskamp is a neat guy, with  some  for-real gunfight experiences.  I took the class in February, and am still waiting on Utah to send the permit.  He teaches the class at the Sandoval county courthouse at Idalia and Hwy 528.  http://omegadefense.com/

It's a $25 civil infraction if you CCW without a license in New Mexico. Honestly, it's less of a punishment than a parking ticket. It's not as close of a call as you think:)

Carrying a concealed weapon without a CCW is a petty misdemeanor in NM . The fine is listed as follows: "petty misdemeanor punishable by a fine not to exceed five hundred dollars ($500). "

But is it true you can CC a "Unloaded" handgun without the permit since the law only states that you need a permit to conceal a loaded weapon? If so, is there a minimum distance that the ammunition has to be from the handgun? I heard through the grapevine that someone got busted for this, so I am not sure (He heard it from a friend sort of thing). Anyone have any experiences doing this?

As strange as it sounds, that is true. Here is the statute:

30-7-2. Unlawful carrying of a deadly weapon.
A.     Unlawful carrying of a deadly weapon consists of carrying a concealed loaded firearm or any other type of deadly weapon anywhere, except in the following cases:
(1)     in the person's residence or on real property belonging to him as owner, lessee, tenant or licensee;
(2)     in a private automobile or other private means of conveyance, for lawful protection of the person's or another's person or property;
(3)     by a peace officer in accordance with the policies of his law enforcement agency who is certified pursuant to the Law Enforcement Training Act [ 29-7-1 NMSA 1978];
(4)     by a peace officer in accordance with the policies of his law enforcement agency who is employed on a temporary basis by that agency and who has successfully completed a course of firearms instruction prescribed by the New Mexico law enforcement academy or provided by a certified firearms instructor who is employed on a permanent basis by a law enforcement agency; or
(5)     by a person in possession of a valid concealed handgun license issued to him by the department of public safety pursuant to the provisions of the Concealed Handgun Carry Act [ 29-19-1 NMSA 1978].
B.     Nothing in this section shall be construed to prevent the carrying of any unloaded firearm.

C.     Whoever commits unlawful carrying of a deadly weapon is guilty of a petty misdemeanor.

Man, sometimes I love this state.

I shudder to think what NH would do to a person carrying w/o a license. ;)

You can cc without permit and have your mag in a holder or pocket as long as it is not in the firearm.
