I am currently in Yuma, Az. for military training, and had to go to Camp Pendleton, Ca. for a memorial service. On our way back to Yuma, I was stopped by CHP for doing 73 mph, in a 70 mph zone. After the initial encounter with the officer in which he took my DL, Mil ID and rental car agreement, he asked me to step out of the vehicle and begins to berate me for not informing him that I had a concealed weapon permit. I politely inform him, that as I was not currently carrying my weapon on my person or in my vehicle, I did not have an obligation to inform him, and that further more since the Peoples Republic of California does not honor any other states concealed weapons permits, that I would at no time be carrying a concealed weapon in his fine state. After an additional five minutes of of lecturing me, he informs me that he is confiscating my Ohio permit, I politely ask him on what grounds, he says because I failed to inform him............ here we go again, at this point I ask him to call his supervisor, his shift surpervisor shows up and pulls him aside and asks him what the situation is, he then asks me and I tell him my side. he tells the officer to return my DL and Mil ID and send me on my way................. | Sounds like a bad situation turned out good for you. The officer was wrong, but I'm glad you had him call his supervisor, who straightened him out and hopefully will go back and get the rest of the crew up to speed on how to handle things.

| Hey judgedby......... you indicate in your profile that you live in North Carolina. How is it that you have an Ohio CHP? It is my understanding that unless you maintain a residency in Ohio an Ohio CHP is void since Ohio does not offer its CHP to non-residents. If you have no other CHP (other than Ohio) and are no longer an Ohio resident then you may want to avoid carrying concealed since the CHP would be void.

As I understand it, police aren't supposed to unilaterally revoke permits without due process. Whether they physcically confiscate them at the time or not, I would assume that it's still valid unless/until revoked on the basis of some hearing. I may be wrong, but a drivers license is not automatically void even for drunk driving arrests in Ohio - a judge has to rule on it.

| Police don't have the authority to Revoke anything. In this instance the police had no reason or authority to sieze a valid permit issued by another State which had nothing to do with the situation whatever. 4A and 5A violation... maybe others. What do they teach these clowns in the Academy now? Stalinism? Maoism? 'Cop didn't like the fact that a citizen (I'm assuming an active duty Marine or Sailor) had a CWP... (which is valid in AZ... NC too prob'ly). 'Shows ya where this pinko cops allegiences lie. Kommiefornia could fall into the Pacific for all I care... but I WOULD be filing a formal complaint. This is JBT mentality at it's core.

File the complaint but praise the supervisor for not having his head up his behind.

No I didn't miss the military thing. Other than posting in the Ohio section there was no information previously provided to indicate that you live in Ohio. Your profile says NC and you discussed AZ and CA, but nothing in reference to Ohio except the permit.

Sonora, you are correct my permit is valid in the great state of Az. as well as NC, I have been in contact with the Winterhaven post of the CHP, and the on shift Lt. has assured me that the young officer will be contacting me to apologize. In one aspect I can understand his reaction, it was late at night on an unlit stretch of I-8, and there were two of us in the vehicle.

True I should have been more clear, I would like to get NC permit, by the good sheriff Brown of Onslow County, NC. does not like to issue permits, to military stationed in his county, in fact he throws a hissy fit over the fact that a lot of Marines in jacksonville, NC have permits from thier home states that are valid in NC. You should the hassles I went through when I went to Sheriff's dept. to process my paper work for my FFL. I thought the clerk was going to go into cardiac arrest when he found out I had an Ohio permit

Used to party in Red's Roost in Winterhaven before Rt 8 wiped out Rt 80 along with Red's. Was stationed at MCAS Yuma. 'Left my pistol at a bar down the road (gone now too) so I could pick it up when I shifted colors (crab clothes). Never CC'd then... but OC's been legit since Cochise was a pup. I was an Ordie (Navy). I'd demand a written apology at the very least from that punk.
These civilians don't understand 'Home of Record'... 'figured you were Ohioan right off.
As an aside... I drove up from NORVA to MD DMV to get a new MD drivers license when they finally put pictures on 'em... rather than my long outdated pink paper one back in '79 or '80. They saw what I put for 'Residence' "USS NIMITZ CVN-68 FPO NY/NY" You can't live there! "Tell the Navy that." Well... you'll haft'a get a VA license. "No... ships ain't spot welded to the pier." The ship is (was) home ported in Virginia... Pier 12 NOB. "But it's NOT Virginia... it's USS Boat." Well... then you have to get a NY license. "Nope... 'Don't live there either... it's the Fleet Post Office for the entire east coast (1st and 6th Fleet) Navy." Well... don't you have parents... brother or sister in MD? "Nope..." Well... we can't give you a new license. "MD's my present home of record... You have to.... I pay State Taxes and MD don't have any qualms 'bout takin' my money." Well do you have friends here. 'Yeah... but I don't live there." Finally gave 'em a friend of mine's address... even tho I didn't live there.
They can't imagine anybody actually "LIVING" aboard ship. There's no allowances for that. I should'a escaped to Arizona long before I finally did.

| judgedby.... if you are considered a resident of the NC county make your CCW application to the sheriff and if he denies it you have a means of redress through the court system, which should override the sheriff and you'll get your permit provided that you meet the criteria. By having a NC CCW permit you should also be able to purchase handguns in NC without petitioning the sheriff for a handgun purchase permit as well. That is why I like Az. I purchased a Glock 21 while I was here, they shipped to my FFL back in NC, that would have never happened back in NC, if you are not resident, you stand a snow balls chance in hell, when it comes to hand gun purchases. You need a permit to purchase a pistol, and no resident, no permit in NC

yeah I have started my paperwork, the Sheriff makes it a pain in the ass for military, we have to get permission from our C.O. to be able to apply for the permit, then WE have to do the background checks for any residency you have had in the last 10 years, but the Sheriff still wants the $85.00 for doing the background checks. he does everything legally in his [power to discourage military from applying

| I don't see how he can have different standards for military than he does for non-military. You may want to peak around in the North Carolina section of this board and get to know the NC gun rights groups and seek help from them. It's seems a bit ridiculous that this kind of stuff is going on.

he will issue the permit he just makes it a painful process, it is the same way with the pistol purchase permit, meanwhile the guys stationed two counties over can go to a gun show in thier county and get a purchase permit issued that day at the gun show

| Well whenever you get your NC CCW permit then he is out of the loop for the purchase of pistols as you are no longer required to obtain a permit when you have a NC CCW permit, if I recall correctly.

I think that the NC general assembly was trying to change that, but as far as I know, if you have a NC concealed permit you do not need a pistol purchase permit, currently
