OC arrest in Racine

A friend of mine was arrested slightly more than two hours ago in Racine on his own front porch.

He was sitting on his front porch armed with a Springfield1911 when 2 officers approached, asked if his gun was real, then began cursing at him about why he had a gun.  They were telling him how it is illegal for the gun to be loaded or "Cocked and Locked" as it were.  They then began to let him know he had no right to carry a gun (while he is sitting on his own front porch) and then arrested him for refusing to give his name (while he is sitting on his front porch). 

He is currently sitting in a Racine Police Station not speaking a word to anyone, keeping silent as is his right.  Words do not describe my shock and awe at the pitiful incompetence of the officers of the Racine Police Department.  I am too angry to write more detail into this account.  If my friend gets out tomorrow, he may update this thread with the details of the encounter.  Until then, lets get some case law (stop and ID, related to ones home, etc) into this thread so we can reference it while we discuss.

Sitting on the front porch of his own house? He was't even doing anything suspicious like planting a tree or something.:banghead::cuss:

I don't even know where to start. This is astounding. Obviously these two officers are up to their necks in poop right now. I don't know how their supervisor will let this stand, let alone the DA.

As far as case law goes, I think Krause vs West Allis is a fresh case and would definitely apply here. I know it is not a SSC case but it does set some precedence.

Wow, simply wow...

I'd hold off until things are cleared up before posting more details.  Seriously, this is out of hand.  I will take the cop's side in many situations (probably about 95% of the time).  This is way out of line and not only is civil action in order (assuming the details you are giving are accurate and there's no major factors being left out), but a formal complaint, and maybe somehow we can turn this into a change for more official or clear writing on WI laws...

I think I need to go to Racine THIS WEEKEND!  Anybody up for a road trip?

Sigh, unbelievable. 

I don't know if it's just me, but it seems to me that the anti-OC element in this state got knocked down for a 9-count by the AG memo but lately they've staggered to their feet and are trying to swing wildly back at us.  It's time for a second round k.o.

My daughter was just born and will not even be 2 weeks old, so might be kinda hard to get out, but pencil me in as a "hopeful".

If I can promise my fiance a night off next week from the baby, she'd probably let me go...

That is awful. How stupid can the cops be after seeing what has happened with OC court cases lately? After the Attorney General's memo a little while back - didn;t the Racine police chief come out and say that OC'ers wouldn't be bothered? I thought you couldnt be ordered to provide identification unless suspected of committing a crime - and OC has been clearly defined as NOT a crime.

Here is the most recent case I heard of. Mike had it posted on the home page. Not only would it apply to open carry on your own property, it would also apply to business property such as a movie theater or Chinamart.

Look on the bright side. This guy is in line for substantial damages and these (expletive) cops will likely get their heads handed to them.

It's a shame that with all their other problems cops have to be saddled with co-workers like these.

Another case of LEOs talking out of their asses just to get the person worried or pissed off, to bow to their false authority.  Why does it have to be this way?

Our founding fathers would find this quite disturbing.  I don't need to tell you what they might have done in the situation.

A Springfield 1911 in Racine......   I met a guy that fits that description before.  I wonder if he'll need any help doing yard work or anything else around his place when he gets out.

Also, saw it in the paper this a.m. Kenosha buisness owner shoots criminal who came into his store, attempting to rob him- and pulled a gun on the store owner. The Police gonna come get him too? Maybe they will come for me? I carry at my shop..............come and get me.

One inch forward, 6 yards back. I read on a Virginia forum here, how some guy was hauled out of a theater by the Police, treated VERY badly. The judge handed down a decision that the Police violated his 4th Admendment rights. If anyone's followed me around on here, you've noticed on many occassions I've argued for restraint, and cooperation by the OCer when interacting with the Police. I will do that no more.

I have been notified that our member(s) family was able to post bond (extortion, blackmail, ransom) and he was returned to his family at about 4:00AM this morning.

It no longer matters is ALL gun owners support our right to OC in WalMart, or where ever.  This member was SEIZED FROM HIS OWN HOME AND ALL GUN OWNERS MUST NOW UNITE AGAINST THE TYRANNY!

It is time to ACT!

Every member here should be calling EVERY TALK RADIO show and news TV station.  We need this on the air TODAY!  We also need to be calling ALL our elected officials and asking them WHEN did we loose the right to be safe and secure IN OUR OWN HOME!

We are organizing a support group for the victim and his family.  The emotional hardship that the Racine Police Department placed on him and his family is unconscionable.    There is DEFINITELY going to be a ROAD TRIP to RACINE this weekend from me and several of the West Coast (Wisconsin West Coast that is) members, stay tuned more to come......
