This is a very near and dear topic that we must put into full action here in Mobile Al. and existing nearby cities and counties. To protect our open carry rights and to constantly educate the public here that open carry is legal and to not be alarmed by us , just cause we choose to use our God given rights to bare arms on our hip and etc.

that would be great and the ones of us on here that live near mobile but over in mississippi can come over and participate. We cant seem to make much progress to arrange a meeting for the mississippi group.

Better be aware of the law against having firearms at a public gathering.. and this would probably meet the definition.

First of all. There is nothing legal in Alabama regarding rounds in chambers or not. IIRC some states do make a distinction... (VA maybe? Or was it Utah? I forgot).

Second. Your interpretation of a public place is flawed.

It is clearly defined in CoA Section 13A-11-59:


(4) PUBLIC PLACE. Any place to which the general public has access and a right to resort for business, entertainment or other lawful purpose, but does not necessarily mean a place devoted solely to the uses of the public. Such term shall include the front or immediate area or parking lot of any store, shop, restaurant, tavern, shopping center or other place of business. Such term shall also include any public building, the grounds of any public building, or within the curtilage of any public building, or in any public parking lot, public street, right-of-way, sidewalk right-of-way, or within any public park or other public grounds.


However, it's not illegal to carry at a public place, only to a demonstration at a public place:


(b) It shall be unlawful for any person, other than a law enforcement officer, to have in his or her possession or on his or her person or in any vehicle any firearm while participating in or attending any demonstration being held at a public place.


Demonstration is further defined as being political in manner:


(1) DEMONSTRATION. Demonstrating, picketing, speechmaking or marching, holding of vigils and all other like forms of conduct which involve the communication or expression of views or grievances engaged in by one or more persons, the conduct of which has the effect, intent or propensity to draw a crowd or onlookers. Such term shall not include casual use of property by visitors or tourists which does not have an intent or propensity to attract a crowd or onlookers.


So, a concert or football game would not be a demonstration at a public place. However, if your intent is to draw attention to yourself over carry rights, that may be construed as being a demonstration. You probably wouldn't be convicted in the end, but you might have some fun-time in court.

I think Kurt was just giving some friendly advice. When I was planning the litter pickup in Dothan he also brought the Demonstration law to my attention. I was thankfull for the heads-up and just changed my wording from an OC litter pickup to Just a Litter Pickup and everyone is invited including people who oc or cc.

In otherwords, you and your friends may be doing some shopping at wal-mart on the 25th and hey, if those buddies happen to express thier right to oc while there, who are you to tell them they can't.  ;)

Cell phone users allowed, and empty holster pro 2nd amendment activist please come out to support to oc cause with nothing but a empty holster. We can't demonstrate any other way in the state of Al. So let's follow the law, be safe, and please Do Not bring any firearms. Thank you.
